1. Introduction and Acceptance of Terms
This website is owned and operated by Piedra Muda LAB (Marc Molinos Vallugera), a sole proprietorship established under Spanish law, with registered address at Plaça de Ramon Berenguer el Gran, 2, Barcelona, Spain. These Terms and Conditions ("Terms") constitute a legally binding agreement that governs the access to and use of the website piedramudalab.com and all services provided thereunder. The website provides multidisciplinary creative services specializing in video design for contemporary arts and innovative visual meditation experiences through the proprietary CHŌWA methodology. Access to or use of the website or any services constitutes acceptance of these Terms in their entirety. Should any party disagree with these Terms, access to the website and services must be discontinued immediately.
2. Definitions
For the purposes of these Terms, the following definitions shall apply with full legal effect:
i. "Service" or "Services" shall mean all services provided by Piedra Muda LAB, including but not limited to CHŌWA visual meditation sessions, video design for opera and contemporary arts, interactive visual experiences, creative consulting services, and any ancillary services provided in connection therewith.
ii. "CHŌWA" shall mean the proprietary visual meditation methodology developed by Piedra Muda LAB, which combines biometric sensor technology with personalized contemplative visuals based on mathematical principles and natural patterns, subject to intellectual property protection under Spanish and international law.
iii. "User" shall mean any natural or legal person who accesses or uses the website or services, regardless of the extent or nature of such use.
iv. "Content" shall mean all materials, information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials available through the services, whether created by Piedra Muda LAB or third parties.
v. "Biometric Data" shall mean physiological and behavioral characteristics collected through sensor technology during CHŌWA sessions for the purpose of personalizing the meditation experience, processed in accordance with applicable data protection regulations.
vi. "Intellectual Property Rights" shall mean all intellectual property rights worldwide, including but not limited to patents, trademarks, service marks, copyrights, trade secrets, know-how, and any applications therefor.
3. Eligibility and User Requirements
Access to and use of the website and services is subject to strict eligibility requirements. Users must be at least eighteen (18) years of age or have attained the age of majority in their jurisdiction of residence, and must possess full legal capacity to enter into binding contractual agreements. Use of the website and services is prohibited where such use would violate applicable laws or regulations in the user's jurisdiction.
i. Participation in CHŌWA visual meditation sessions requires users to be in good physical and mental health. Users with medical conditions that may be affected by meditation practices, biometric monitoring, or exposure to visual stimuli must obtain prior medical clearance from qualified healthcare professionals before participation.
ii. Users must provide accurate, current, and complete information during the booking process and maintain the accuracy of such information throughout the duration of their relationship with Piedra Muda LAB.
iii. Users bear sole responsibility for maintaining the confidentiality of account credentials and for all activities conducted under their accounts, including unauthorized use by third parties.
iv. Users must comply with all applicable laws, regulations, and professional standards in their jurisdiction when accessing or using the services.
4. Description of Services
The booking of any service constitutes acknowledgment that the user has thoroughly reviewed all service descriptions, terms, and conditions applicable to such service, and creates a legally binding contractual obligation to receive the service upon completion of the booking process and any required payment.
i. CHŌWA visual meditation sessions utilize proprietary biometric sensor technology combined with personalized contemplative visuals based on mathematical principles and natural patterns. Session formats include trial sessions of thirty (30) minutes duration, comprehensive initial assessment sessions of ninety (90) minutes duration, standard meditation sessions of fifty (50) minutes duration, and customized session packages with personalized therapeutic programs.
ii. Video design services encompass the creation of interactive installations and creative consulting for opera houses, theaters, and contemporary art venues, with specific project requirements, deliverables, timelines, and technical specifications defined in separate written agreements.
iii. Service availability remains subject to scheduling constraints, technical requirements, facility capacity, and staff availability. Piedra Muda LAB reserves the absolute right to modify session formats, technical specifications, or service parameters as deemed necessary to maintain service quality and safety standards.
iv. Piedra Muda LAB retains the unilateral right, exercisable without prior notice, to modify, suspend, or discontinue any service or service feature, establish usage limitations, or permanently or temporarily terminate access to services without liability, regardless of reason or absence thereof.
5. User Conduct and Responsibilities
Users must conduct themselves in accordance with all applicable laws, regulations, and professional standards when accessing or using the website and services. Prohibited conduct includes, but is not limited to, any unlawful activity or activity that violates the terms set forth herein.
i. Users are strictly prohibited from transmitting, distributing, posting, or submitting any information concerning third parties without proper authorization, including but not limited to photographs, personal contact information, or financial account details.
ii. Users must not engage in any conduct that could damage, disable, overburden, or impair the services or interfere with other parties' use and enjoyment of the services, including but not limited to denial-of-service attacks, system overloading, or network disruption.
iii. Unauthorized access attempts to any portion of the website, services, user accounts, or connected computer systems or networks through hacking, password mining, social engineering, or any other means are strictly prohibited and may result in criminal prosecution.
iv. During service provision, users must treat staff, facilities, and other participants with respect and professionalism, comply with all safety instructions and operational guidelines, refrain from disrupting sessions or interfering with equipment, maintain strict confidentiality regarding other participants' experiences and personal information, obtain explicit written permission before recording, photographing, or sharing any session content, and provide complete and accurate disclosure of any health conditions that may affect participation or safety.
6. Intellectual Property Rights
All services, materials, content, methodologies, and intellectual property associated therewith, including but not limited to software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, video, music, visual content, artistic creations, proprietary meditation techniques and methodologies including the CHŌWA methodology, technical innovations, website content and design, and all related Intellectual Property Rights, constitute the exclusive property of Piedra Muda LAB and Marc Molinos Vallugera.
i. No provision of these Terms shall be construed to grant any license or right in or to any Intellectual Property Rights, and users expressly agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any proprietary content or intellectual property.
ii. The CHŌWA methodology is subject to pending patent protection and extensive proprietary rights under Spanish and international intellectual property law. Any unauthorized use, reproduction, distribution, or commercialization of this methodology constitutes intellectual property infringement and may result in civil and criminal penalties.
iii. All visual content, artistic creations, technical innovations, and derivative works developed during service provision remain the exclusive property of Piedra Muda LAB unless expressly agreed otherwise in a separate written agreement executed by authorized representatives.
iv. Users acknowledge that any feedback, suggestions, or ideas provided regarding the services may be used by Piedra Muda LAB without compensation or attribution, and users hereby assign all rights in such contributions to Piedra Muda LAB.
7. Privacy and Data Protection
Personal data collection and processing is conducted in strict accordance with the Privacy Policy and all applicable data protection legislation, including but not limited to Regulation (EU) 2016/679 (General Data Protection Regulation), Ley Orgánica 3/2018 de Protección de Datos Personales y garantía de los derechos digitales, and other relevant Spanish and European privacy legislation.
i. CHŌWA sessions may involve the collection and processing of biometric data through sensor technology for the exclusive purpose of personalizing the meditation experience. Such biometric data processing is conducted only with explicit user consent and is limited to service personalization and quality improvement purposes.
ii. All personal data is handled with appropriate technical and organizational security measures designed to protect against unauthorized access, alteration, disclosure, or destruction, in compliance with industry best practices and regulatory requirements.
iii. Use of the services constitutes consent to personal data collection and processing as described in the Privacy Policy, which forms an integral component of these Terms and is incorporated herein by reference.
iv. Users retain all rights under applicable data protection legislation, including but not limited to rights of access, rectification, erasure, restriction of processing, data portability, objection to processing, and withdrawal of consent, exercisable in accordance with legal requirements and procedures.
8. Payment Terms and Pricing
All service pricing is displayed on the website and remains subject to modification without prior notice. Payment is required at the time of booking unless alternative arrangements have been expressly agreed in writing.
i. Piedra Muda LAB reserves the absolute right to modify pricing for any services at any time and to correct pricing errors that may occur inadvertently, with such corrections taking immediate effect.
ii. All fees and charges are non-refundable except as specifically provided in the separate Refund Policy or as required by mandatory provisions of applicable consumer protection law.
iii. Additional charges may apply for specialized services, extended session durations, premium technical requirements, or services exceeding standard offerings, with such charges disclosed prior to service provision.
iv. Payment processing is subject to third-party payment processor terms and conditions, and users are responsible for ensuring payment method validity and sufficient funds availability.
9. Cancellation and Termination
Piedra Muda LAB may permanently or temporarily terminate or suspend user access to services without notice and without liability for any reason, including but not limited to violation of these Terms or applicable law, as determined in Piedra Muda LAB's sole discretion.
i. Users may discontinue service use and request account cancellation at any time by providing written notice to contact@piedramudalab.com, subject to any outstanding contractual obligations or payment requirements.
ii. Upon termination, user rights to access and use services cease immediately, and Piedra Muda LAB reserves the right to remove or delete any user information, including account credentials and personal data, subject to legal retention requirements.
iii. Cancellation policies for individual sessions and service packages are governed by the separate Refund Policy and applicable consumer protection legislation.
iv. Termination does not relieve users of obligations incurred prior to termination, including payment obligations, confidentiality requirements, and intellectual property restrictions.
10. Warranties and Disclaimers
All website information and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by Spanish law, Piedra Muda LAB disclaims all representations, warranties, conditions, and terms, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
i. No representations are made regarding the suitability, reliability, availability, timeliness, accuracy, or completeness of any information, software, products, services, or related materials contained on the website or provided through the services.
ii. Services are provided without warranties of any kind, and users acknowledge that participation in sessions involves inherent risks. Piedra Muda LAB assumes no responsibility for any health conditions, injuries, or adverse effects that may arise during or after service provision, and users participate entirely at their own risk.
iii. While reasonable measures are implemented to maintain service quality and security, no warranty is provided that services will be uninterrupted, error-free, or completely secure, and users acknowledge the inherent limitations of technology-based services.
iv. Any oral or written information or advice provided by Piedra Muda LAB representatives does not create warranties or expand the scope of these Terms.
11. Limitation of Liability
To the maximum extent permitted by Spanish law, Piedra Muda LAB and Marc Molinos Vallugera shall not be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising from or relating to website use or service provision, regardless of the theory of liability and whether or not advised of the possibility of such damages.
i. Piedra Muda LAB assumes no liability for any errors, mistakes, or inaccuracies in content; personal injury or property damage resulting from website access or service use; or unauthorized access to secure servers or personal information stored therein.
ii. Total liability for any claim arising from these Terms or service provision shall not exceed the amount paid by the user for the specific service giving rise to the claim, regardless of the number of claims or theories of liability.
iii. Certain jurisdictions do not permit the exclusion or limitation of liability for consequential or incidental damages, and such limitations may not apply where prohibited by mandatory law.
iv. Users acknowledge that the limitations of liability set forth herein reflect a reasonable allocation of risk and that Piedra Muda LAB would not provide services without such limitations.
12. Indemnification
Users agree to indemnify, defend, and hold harmless Piedra Muda LAB and Marc Molinos Vallugera from and against any and all demands, losses, liabilities, claims, damages, costs, and expenses, including reasonable attorneys' fees and court costs, arising from or relating to user conduct, website use, service participation, violation of these Terms, violation of third-party rights, or provision of false or misleading information.
i. The indemnification obligation includes but is not limited to claims arising from intellectual property infringement, privacy violations, defamation, negligence, or breach of contract by users.
ii. Piedra Muda LAB reserves the right to assume exclusive defense and control of any matter subject to indemnification, and users agree to cooperate fully in such defense.
iii. This indemnification obligation survives termination of these Terms and continues in perpetuity for claims arising during the term of the agreement.
13. Modifications to Terms
These Terms may be modified at any time at the sole discretion of Piedra Muda LAB. Users are advised to review these Terms periodically to remain informed of any changes.
i. Material changes to these Terms will be communicated through website posting with an updated "Last Updated" date and, where feasible, through email notification to registered users.
ii. Continued use of the website or services following any modification constitutes acceptance of the modified Terms in their entirety.
iii. Users who disagree with any modification must discontinue website use and service participation immediately upon such modification taking effect.
iv. No modification shall be effective unless posted on the website or otherwise communicated in accordance with these Terms.
14. Governing Law and Dispute Resolution
These Terms and all related rights, remedies, claims, and disputes shall be governed by, construed under, and enforced exclusively in accordance with the substantive laws of Spain, without regard to conflict of laws principles.
i. Any disputes arising from or relating to these Terms or service provision shall be subject to the exclusive jurisdiction of the competent courts of Barcelona, Spain, and users hereby consent to such jurisdiction and venue.
ii. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded from application to these Terms.
iii. Prior to initiating formal legal proceedings, parties agree to attempt good faith resolution through direct negotiation and, if necessary, mediation conducted in accordance with Spanish mediation procedures.
iv. Users waive any right to trial by jury and agree that any disputes shall be resolved through individual proceedings rather than class action or collective proceedings.
15. Severability
Should any provision of these Terms be determined to be unenforceable or invalid under applicable law, such determination shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
i. Invalid or unenforceable provisions shall be deemed severed from these Terms without affecting the validity of the remaining provisions.
ii. Where feasible, invalid provisions shall be replaced with valid provisions that most closely approximate the intended economic effect of the original provision.
iii. The invalidity of any provision in a particular jurisdiction shall not affect the validity of such provision in other jurisdictions where it may be enforceable.
16. Entire Agreement
These Terms, together with the Privacy Policy and any additional service-specific terms and conditions, constitute the entire agreement between users and Piedra Muda LAB regarding website use and service provision, and supersede all prior or contemporaneous communications, agreements, and understandings, whether written or oral.
i. Additional terms and conditions may apply to specific services or promotional offerings, which will be presented at the time of service selection or purchase.
ii. No modification of these Terms shall be effective unless made in writing and executed by authorized representatives of Piedra Muda LAB.
iii. The failure to enforce any provision of these Terms shall not constitute a waiver of such provision or the right to enforce it subsequently.
iv. These Terms are binding upon users and their successors, assigns
